The suit involved Cabeau's accusation that the global retail giant infringed on its intellectual property rights for Cabeau's flagship product, the Evolution® Pillow. The Intellectual Property Department at Cabeau discovered that Jack & Jones was selling a product that duplicated Cabeau's world renowned Evolution® design, both in Chinese stores and in its online sales platform. Upon this discovery, Cabeau took swift legal action in filing a complaint in Chinese prefectural court. The final ruling in the case found that the pillow offered by Jack & Jones had significant similarities to the Evolution® Pillow, and would cause confusion to the general public. The Court ordered Jack & Jones to pay monetary damages of a confidential amount to Cabeau and to immediately cease manufacturing, selling, and offering for sale the infringing product. As a result of the litigation, Jack & Jones has halted all manufacturing and sales of the contested pillow, and has chosen not to appeal the decision of the court. The decision is thus final and payment has been received from Jack & Jones.
